18.     The Committee is concerned that conditions under which stateless children may apply for Dutch nationality under the present Nationality Act, which among others requires three years of legal residency, are very strict. Recalling its previous recommendations, the Committee recommends that the State party:

(a)        Ensure that all children born in Aruba and Curaçao, including those with an irregular residence status, have access to birth registration and/or identity cards, and strengthen legal pathways to acquire a nationality;

(b)        Guarantee all stateless children born or present within the territory of the State party the right to acquire nationality irrespective of residency status;

(c)        Implement measures for ensuring that children with an “unknown” nationality, a status that leaves them unable to be registered as stateless and obtain international protection, do not remain in such a status for a prolonged period of time;

(d)        Ensure the access to education, health, and social services for stateless children and children with an “unknown” nationality;

(e)        Ensure that no child, including those between 16 and 17 years of age, is deprived of his or her nationality for actions that are considered to constitute a threat to national security, and also consider children’s best interests when such withdrawals of nationality are imposed on parents.

(b) Consider ratifying the Convention relating to the Status of Stateless Persons, the Convention on the Reduction of Statelessness, the European Convention on Nationality and the Council of Europe Convention on the Avoidance of Statelessness in relation to State Succession.

41. Recalling joint general comments No. 3 and No. 4 of the Committee on the Protection of the Rights of All Migrant Workers and Members of Their Families/No. 22 and No. 23 (2017) of the Committee on the Rights of the Child on the human rights of children in the context of international migration, the Committee reiterates its previous recommendations12 and urges the State party to:

33. Taking note of target 16.9 of the Sustainable Development Goals, the Committee reiterates its previous concluding recommendations and urges the State party to:

(a) Harmonize civil registration laws with the Children’s Protection and Welfare Act;

(b) Address administrative barriers to birth registration, including by continuing its efforts to ensure a free, timely and simplified process and to establish a countrywide system of birth registration in health facilities and a system of e-registration;

(c) Increase public awareness about the importance and process of birth registration in communities, as well as incentives, including with the support of traditional authorities and religious leaders.

Recalling its previous concluding observations and taking note of target 16.9 of the Sustainable Development Goals, the Committee recommends that the State party urgently finalize the reform of the legislation on nationality, including the adoption of the citizenship bill, and implement the national action plan on eradicating statelessness, to ensure that a child can derive nationality also from the mother and that children born in the State party are not at risk of being stateless.

Taking note of target 16.9 of the Sustainable Development Goals, the Committee recommends that the State party:

(a) Remove all administrative and financial barriers faced by children in gaining access to birth registration and receiving birth certificates, including by allowing for late registration without a judicial appeal;

(b) Ensure that all children, including migrant children, children with non-Arabic names and children who were born prior to the repeal of Circular No. 85 of 1965, have access to birth registration and identity documents, regardless of their parents’ residency status.
