6. Recalling its general recommendation No. 8 (1990) concerning the interpretation and application of article 1 (1) and (4) of the Convention, and its guidelines for reporting under the Convention, the Committee recommends that the State party produce disaggregated statistics on the socioeconomic situation of minority groups, including members of the Roma and Serb minorities, and of non-citizens such as refugees, asylum-seekers, migrants and stateless persons, and on their access to education, employment, health care and housing with a view to creating an empirical basis for assessing the equal enjoyment of the rights enshrined in the Convention. (...)

20. The Committee recommends that the State party intensify its efforts to enhance the provision of legal aid to those vulnerable to racial discrimination, including members of the Roma and Serb ethnic minorities, migrants, refugees, asylum-seekers and stateless persons, including by allocating adequate financial resources and by ensuring the availability of legal aid at the regional and local levels. It also recommends that the State party raise public awareness about the availability of legal aid services in cases of racial discrimination.

28. The Committee recommends that the State party establish a dedicated and effective procedure for determining statelessness and take measures to ensure that stateless persons, particularly undocumented children, are able to enjoy their economic and social rights without discrimination, in particular regarding access to health-care services and education, including by providing them with a personal identification number.

6. Recalling the guidelines for reporting under the Convention, the Committee recommends that, in its next periodic report, the State party use the results of the population and housing census of 2022 to provide updated disaggregated data on the ethnic composition of the population, based on the principle of self-identification, on non-citizens, including migrants, refugees, asylum-seekers and stateless persons, and on the prison population. The Committee also recommends that the State party provide detailed information on the access of persons from ethnic minorities to education, employment, health care and housing and their representation in public and political life, where applicable, with a view to creating an empirical basis for assessing the equal enjoyment of the rights enshrined in the Convention.

30. The Committee recommends that the State party ensure that restrictions on freedom of movement conform to the strict tests of necessity and proportionality, are decided upon only by the competent authorities in accordance with the law and do not discriminate on grounds of racial background, nationality, ethnicity or refugee status.

10. The Committee is concerned about the lack of data disaggregated by disability, ethnic origin and socioeconomic and migration background, as this does not allow for sufficient analysis of the situation of children, and recommends that the State party:

(b) Strengthen the collection and analysis of data on discrimination against children, children with disabilities, statelessness and children with an “unknown nationality”, the socioeconomic situation of children, and violence against children, including abuse, neglect and sexual exploitation;

21. The Committee notes the amendment to the Citizenship Act (2001) made in 2021 that removes the requirement for certain stateless children to have a permanent residence permit in order to obtain Swedish nationality, but is concerned that the legislative framework remains restrictive, including for children with an irregular residence status, stateless children born abroad and children with an “unknown nationality”. The Committee recommends that the State party:

(a) Develop a procedure to determine the stateless status of children in order to properly identify and protect stateless children;

(b) Facilitate the acquisition at birth of nationality for children who would otherwise be stateless;

(c) Strengthen legal pathways for children with an irregular residence status, children born abroad and children with an “unknown nationality” to acquire a nationality.

6. Recalling its guidelines for reporting under the Convention, 3 the Committee recommends that, in its next periodic report, the State party provide statistics on the ethnic composition of the population, including asylum-seekers, refugees, stateless persons and migrant workers, and on the enjoyment of economic, social and cultural rights, disaggregated by ethnic origin and by national origin, in order to provide the Committee with an empirical basis for evaluating the equal enjoyment of rights under the Convention.

22. In the light of its general recommendation No. 30 (2004) on discrimination against non-citizens, especially paragraph 16 on reducing statelessness, in particular statelessness among children, the Committee recommends that the State party expeditiously bring its legislation into line with the Convention by amending its Citizenship Act to eliminate provisions that discriminate against foreign nationals married to Bahraini women and against the children of Bahraini women married to foreign nationals, and add provisions allowing Bahraini women to transmit their nationality to their foreign-national spouses and to their children from birth, on an equal footing with men. The Committee also recommends that the State party ensure that particular groups of non-citizens are not discriminated against with regard to access to citizenship compared to others.

24. The Committee recommends that the State party revise the Citizenship Act, including its provisions on deprivation of nationality, to ensure that its application does not result in statelessness and that the Government cannot revoke the citizenship rights of persons exercising their fundamental rights, including the rights to freedom of expression, assembly and association, with a view to preventing statelessness, and consider ratifying the Convention relating to the Status of Stateless Persons and the Convention on the Reduction of Statelessness. The Committee also recommends that the State party find a durable solution to the problems faced by Bidoon, including by considering naturalizing all those who have lived in Bahrain for long periods and have a genuine and effective link to the country. The Committee further recommends that the State party put into place immediate administrative procedures to allow all stateless persons, including Bidoon, to have effective access to basic human rights and to obtain official documents, including birth registration documents.

Ratification of other treaties

35. Bearing in mind the indivisibility of all human rights, the Committee encourages the State party to consider ratifying those international human rights treaties that it has not yet ratified, in particular treaties with provisions that have direct relevance to communities that may be subjected to racial discrimination, including (...) the Convention relating to the Status of Stateless Persons and the Convention on the Reduction of Statelessness.

Paragraphs of particular importance

44. The Committee wishes to draw the attention of the State party to the particular importance of the recommendations contained in paragraphs 10 (legal framework for combating racial discrimination), 12 (special measures), 18 (racist hate speech and hate crimes), 20 (civil society organizations) and 24 (statelessness) above and requests the State party to provide detailed information in its next periodic report on the concrete measures taken to implement those recommendations.

6. Recalling its general recommendation No. 8 (1990) concerning the interpretation and application of article 1, paragraphs 1 and 4 of the Convention, its guidelines for reporting under the Convention and its previous recommendations, the Committee recommends that the State party collect and provide to the Committee updated and comprehensive statistics on the demographic composition of the population, based on the principle of self-identification, disaggregated by ethnic or national origin, including on Maroons, Tainos, Rastafaris and non-citizens, such as migrants, refugees, asylum-seekers and stateless persons, together with relevant socioeconomic indicators that would enable an accurate assessment of progress towards the equal enjoyment by all groups, without discrimination, of the rights enshrined in the Convention.

28. (...) It also recommends that the State party adopt comprehensive legislation to eradicate statelessness, which includes procedures for the determination of statelessness, and consider acceding to the Convention relating to the Status of Stateless Persons.
