The Committee notes the indication of the State party that the regulation of citizenship is a sovereign matter; however, it reminds the State party that article 27 of the Vienna Convention on the Law of Treaties provides that a party to a treaty may not invoke the provisions of its internal law as a justification for its failure to perform a treaty. It recommends that the State party consider reviewing article 6 of the Constitution to ensure that all Bhutanese have the right to transmit their nationality to their children, irrespective of the other parent’s nationality or whereabouts, and that ethnic Nepali Bhutanese women are eligible for Bhutanese nationality, recognizing their strong links with the State party.
