20. The Committee welcomes the establishment of the Civil Registration and Vital Statistics system and the birth registration campaigns, awareness-raising initiatives and special measures with regard to children of non-Gambian parents, which have led to an increase in birth registration. The Committee notes with concern, however, that birth registration remains low, with 59 per cent of children under 5 years of age registered in 2019, and that the majority of children under 5 years of age do not have birth certificates. Recalling its previous recommendations,9 the Committee urges the State party:

(a) To expeditiously finalize the adoption of the amendments to the Births, Deaths and Marriages Registration Act 1990 to interlink the civil registration, vital statistics and health systems and align the civil registration system with international standards;

(b) To implement a digital birth registration system;

(c) To ensure the complete and immediate birth registration of all children, with particular attention to children under 5 years of age, children of unmarried parents and children of non-Gambian parents;

(d) To provide a birth certificate for every registered birth and ensure that all children without a birth certificate have access to essential services;

(e) To ensure the issuance of a birth certificate and an identification card and access to nationality for foundlings living in its territory;

(f) To facilitate the naturalization process for children living in a protracted refugee situation to ensure their access to rights;

(g) To allocate adequate funding to community outreach programmes and media campaigns to raise awareness on the importance and process of birth registration.

32. The Committee recommends that the State Party:

(d) Expeditiously establish and operationalize the national reparations fund for children born of rape and ensure that the fund has sustainable funding, clear implementation timelines and a victim/survivor-centred approach that addresses the specific vulnerabilities and emotional and psychological suffering faced by these children and their mothers, including by taking the necessary measures to eradicate any direct and indirect discrimination in law, in particular ensuring the children’s birth registration and access to civil documentation, providing access to social protection to the children and their mothers and conducting destigmatization and awareness-raising campaigns in line with Security Council resolution 2467 (2019);

30. Recalling its general recommendation No. 32 (2014) on the gender-related dimensions of refugee status, asylum, nationality and statelessness of women, the Committee recommends that the State Party:

(a) Adopt comprehensive legislation establishing a statelessness determination procedure and ensure that all women and girls in the State Party at risk of statelessness have access thereto;

(b) Facilitate women’s and girls’ access to birth registration, especially in rural and Indigenous areas and those with a high concentration of asylumseeking and migrant women and girls, through mobile civil registry units, affordable and easy-to-access procedures, including online, to ensure that they are not excluded from nationality, access to justice, education, healthcare, social benefits and other services;

(c) Ensure that the proposed amendments to the Nationality (Amendment) Act do not discriminate against women and girls on the basis of residency status;

44. The Committee reiterates its previous recommendations (CEDAW/C/BLZ/ CO/4, paras. 9 and 10) that the State Party put in place a comprehensive system of data collection in all areas covered by the Convention to assess the actual situation of women and to track trends over time. The Committee recommends that such a system mainstream gender and intersectionality and comprise, at least:

(a) Quantitative information (disaggregated by sex, ethnicity and rural and urban areas, as well as data on women with disabilities, Indigenous women, including Creole, Garifuna and Maya women, refugee, asylum-seeking, stateless and migrant women and girls, LGBT women, intersex persons and older women);
