(c) Review the Organic Law on Management of Data and Civil Information (ley orgánica de gestion de la identidad y datos civiles), which allows for changing the names of children after birth registration, and introduce safeguards to adequately protect the child’s right to identity and prevent de facto and/or legal amendment of the identity names of children.

In view of the significant number of children under five in the State party without a birth certificate, the Committee, reminding the State party of target 16.9 of the Sustainable Development Goals on providing legal identity for all, strongly urges the State party to continue facilitating access to the birth registration process by expanding the use of mobile civil registration units, speeding up processing times, removing all additional costs, simplifying the supporting documentation requirements and encouraging the reporting of at-home births. It further recommends that the State party seek technical assistance from UNICEF, among others, for the implementation of these recommendations. 

41. While welcoming the 2014 revision of the Refugee Act, which ensures that asylum claims submitted by children who are unaccompanied or separated are analysed under refugee status determination procedures, and further welcoming the adoption of the Constitutional Act on Tajik Nationality (2015) containing general safeguards that protect children against statelessness at birth, the Committee recommends that the State party:

The Committee recommends that the State party ratify the Convention on the Reduction of Statelessness, 1961, and reiterates its previous recommendation (see CMW/C/MEX/CO/2, para. 14) to the State party that it ratify the ILO Migration for Employment Convention (Revised), 1949 (No. 97) and the Migrant Workers (Supplementary Provisions) Convention, 1975 (No. 143) as soon as possible. It also recommends ratification of the ILO Labour Inspection Convention, 1947 (No. 81), Labour Inspection (Agriculture) Convention, 1969 (No. 129) and Domestic Workers Convention, 2011 (No. 189).

In any case, the Committee recommends ensuring access to education and other social services for the children of returning Mexicans, irrespective of their documentation or nationality.

While noting some measures taken to simplify residency registration procedures, the Committee remains concerned about the high number of persons still not registered in the State party, including stateless persons, refugees and holders of temporary asylum and individuals belonging to some minority groups, including migrants and Roma, whose access to social services such as education, health care, employment and housing is as a result impeded (arts. 2, 5 and 6).

30. In accordance with its general recommendation No. 30 (2004) on discrimination against non-citizens, the Committee recommends that the State party take urgent measures to expedite the registration of all those seeking registration in a transparent manner. The Committee also recommends that the State party take measures to bring to an end any discriminatory or arbitrary behaviour by officials involved in registration activities. Moreover, the State party is requested to guarantee that the enjoyment of rights by all individuals in the Russian Federation is not dependent on residence registration. Finally, the State party is encouraged to accede to the 1954 Convention relating to the Status of Stateless persons and the 1961 Convention on the Reduction of Statelessness.
