The Committee also urges the State party to ensure that children born in Madagascar do not risk being stateless.

The Committee recommends that the State party continue and intensify its efforts in ensuring free and compulsory birth registration for all children, including through use of mobile registration centres, and raise public awareness about the importance of birth registration. To achieve this objective, the State party should allocate adequate human, technical and financial resources to ensure easy access to registration by population in rural as well as urban areas.

40. The Committee urges the State party to ensure that all children are properly registered at birth and that birth registration is free and compulsory in practice. To this aim, the State party should:

(a) Adopt the decrees and measures contained in the law on the organization of the civil registry system concerning birth registration, and provide adequate resources for its implementation;

(b) Increase the number of birth registration facilities, including mobile birth registration units, at the local, community and village levels;

(c) Urgently enforce the provisions of the law relating to the organization of the civil registry system in order to regulate and reduce the costs of birth certificates;

(d) Conduct awareness-raising campaigns, with the active support of community leaders, to promote birth registration for all children; and

(e) Guarantee that children without a birth certificate are not deprived of access to education, health care and other social services.

The Committee urges the State party to further review and enact legislation in order to ensure that all children who are at risk of becoming stateless, including children belonging to the disadvantaged groups mentioned in paragraph 41, are provided with access to Thai nationality. The Committee recommends that the State party consider ratifying the 1954 Convention relating to the Status of Stateless Persons and its 1967 Optional Protocol, and the 1961 Convention on the Reduction of Statelessness.

44. The Committee recommends that the State party take measures to ensure birth registration for all children born on its territory especially those who are not registered due to the economic status of their parents, ethnicity and immigration status. It also recommends that the State party carry out public education programmes, including campaigns to provide birth registration to those children already born in the territory of the State party but remain unregistered, as well as remove any monetary penalties for late registrations and take alternative measures to ensure timely registration of new-born children.

The Committee recalls the responsibilities of the State party, in accordance with articles 2 and 7 of the Convention, to ensure that all children within the State party’s jurisdiction have the right to be registered and acquire a nationality, irrespective of the child’s or his or her parents’ or legal guardians’ sex, race, religion or ethnicity, social origin or status. The Committee therefore urges the State party:

(a) To take immediate steps to guarantee that all children of Syrian-born Kurdish parents, including children of stateless Kurds known as Maktoumeen promptly acquire Syrian nationality and enjoy their rights without discrimination;
(b) To proceed with the amendment of the Nationality Act to allow children of Syrian mothers married to foreign nationals to acquire the nationality of their mothers;
(c) To ratify the Convention relating to the Status of Stateless Persons of 1954, and the Convention on the Reduction of Statelessness of 1961.

The Committee urges the State party to strengthen its efforts to ensure the effective registration of all children born in the State party, regardless of their origin and without any discrimination. To this aim, the Committee urges the State party to amend the Personal Status Code, to fully recognize all mixed marriages and to take all the necessary measures to protect and properly register children born out of wedlock and children from remote areas.
